Diego Marquez-Rincon was booked into Beaver County Jail later that same afternoon. He faces one count of forcible sexual abuse, a second-degree felony.

According to the probable cause statement filed in support of his arrest, Marquez-Rincon was a passenger on a Greyhound bus traveling northbound on Interstate 15.

At approximately 9:15 a.m., law enforcement officers were dispatched on a report that the bus driver was about to kick a man off the bus for allegedly harassing a woman who indicated that she wanted to press charges.

The woman told officers the man kept touching her sexually throughout the bus trip, including on her breast and genital areas.

“A witness seated near the victim stated that the suspect had covered his lap with his jacket, and it appeared the suspect was fingering the female victim and that she kept trying to push the suspect away,” the arresting officer wrote, adding, “The bus driver stated that when she separated the victim and suspect, the zipper on his pants appeared open.”

The woman also provided investigators with video and photo evidence from her phone that corroborated her account, according to the affidavit.

After initial contact had been made at the scene by a Utah Highway Patrol trooper and a Beaver County Sheriff’s deputy, agents from the State Bureau of Investigation were subsequently called to interview Marquez-Rincon. He reportedly told them he had been living in a homeless shelter.

“He has no known ties to Beaver, the State of Utah, or the United States and as a result, is a flight risk,” the affidavit states, adding, “The Department of Homeland Security was notified and intends to deport the suspect.”

This report is based on statements from court documents and law enforcement officials and may not contain the full scope of findings. Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
