CEDAR CITY – An Enoch City man is in jail without right to bail after authorities arrested him Monday on allegations of sexual abuse of a child.
Enoch City Police booked David Mangiaracina, 45, into the Iron County Correctional Facility without right to bail Monday.
Enoch Police Chief Jackson Ames was the arresting officer and asked the judge for either no bail or high bail after the suspect allegedly violated a previous order by authorities to stay away from the victim.
Without a court order setting bail for release or allowing him to be released on his own recognizance, promise to appear, Mangiaracina remains in jail pending disposition of his case.
Mangiaracina appeared before 5th District Judge Keith Barnes Wednesday for his initial appearance. Barnes did not change the no-bail order.
Mangiaracina is facing charges on two counts of aggravated sexual abuse of a child, both first-degree felonies and one count of forcible sexual abuse of a child, a second-degree felony. The first-degree felony counts carry a presumptive sentence of 15 years to life, if convicted, according to the charging document, and “Imprisonment is mandatory.”
According to charging documents, Mangiaracina inappropriately touched the female minor victim on several incidents.
The victim described three separate instances when the suspect allegedly touched her – in 2012, 2013 and this year, documents state.
The victim was 12 at the time of the first alleged incident.
Ames said he first interviewed the suspect in March but didn’t arrest Mangiaracina until the case had been thoroughly screened by the Iron County Attorney’s Office.
“I had the county attorney’s office screen the case because I wanted to make sure what charges we could bring against him and how many charges,” Ames said. “I wanted to be comfortable moving forward and knowing that what charges we brought against him were solid.”
Magniaracina’s preliminary hearing is set for May 25.
Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
